A recent court ruling bodes well for originators’ rights, but could add to potential liabilities for securitization investors and servicers.

The ruling by a panel of judges in the New York State Appellate Division, First Department, in ACE Securities v. DB Structured Products finds that the statute of limitations on representations and warranty claims in state securitization trusts ends six years after a deal closes, according to Moody’s Investors Service.
